About DOT Random Drug Tests
The U.S. Department of Transportation, or DOT, is a federal agency that has strict rules and regulations in place to test employees in safety-sensitive functions, such as individuals who operate commercial motor vehicles (CMVs). DOT random testing is one method DOT requires for screening employees for illicit drug and alcohol use.
DOT agencies subject to these random tests include:

- Federal Motor Carrier Safety Administration (FMCSA)
- Federal Transit Administration (FTA)
For DOT random testing processes, employers must put their employees into a testing pool. This pool should ONLY include DOT-regulated employees; non-DOT employees cannot be entered into the same random pool as DOT-regulated employees. Each employee should have an equal chance of being picked during this random selection process. Selected employees must submit samples for testing (and pass the tests) or be immediately removed from safety-sensitive duties.
Are Random Drug Tests Legal?
